New Door-Busting Case Haunts Narc Cops

Det. Justen Kasperzyk — one of two narcotics cops arrested in the bubbling theft, bribery, and gambling scandal — allegedly broke down an innocent man’s door in the Hill after a wild chase one day. Now Kasperzyk’s own front door is at risk: A local lawyer (pictured) has asked a federal judge to secure the 34-year-old detective’s Killingworth home so he can pay back over $500,000 in damages to the man he arrested.
The judge, Mark Kravitz, on Wednesday decided to schedule an April 11 hearing on the request. Kravitz was responding to a pre-judgment remedy filed Tuesday by Attorney Diane Polan (pictured above).
Polan’s lawsuit, filed in U.S. District Court in New Haven, also names the linchpin of the bribery scandal, top narcotics cop Lt. Billy White, who was Kasperzyk’s supervisor at the time and was present at the door-busting incident. White’s home, however, cannot be frozen as an asset because it isn’t owned under his name, said Polan.

The suit claims Kasperzyk gave false information in a police report and illegally broke into a home as he searched for suspects who had been recklessly driving all-terrain vehicles from Dwight to the Hill. Three other policemen are also named in the suit.
The ATV/”Door-Breaking” Caper
Here’s how the pursuit began, according to police reports. (Click here to read police reports and a narrative in the lawsuit).
Officer Paul Bicki was in a patrol car at about 10 p.m. on April 17, 2004, when he heard calls of four ATVs being driven recklessly down Kensington Street. When he flicked on his flashing lights and approached the ATVs, two reversed and sped towards him, then ran up on the sidewalk.
“Pedestrians scampered off the sidewalk to avoid being struck,” wrote Bicki in a police report. The ATVs sped off towards Career High School, where Kasperzyk, alerted via radio, spotted them running a red light at Orchard Street and So. Frontage Road.
Two of the ATVs stopped outside 77 Elliot St. in the Hill.
Kasperzyk got out of his unmarked car, tackled one rider off his motorcycle and arrested him, according to his account in a police report (Exhibit B in this court record).
The lawsuit surrounds what happened to the other arrestee, Jorge Pizarro. Kasperzyk claimed he saw him dash into 77 Eliot St.: “When I got to the front steps [Pizarro] slammed the door shut. I tried to open the door but it was locked. At that point I forced open the front door and caught Pizarro on the second floor.”
The Babysitter
Pizarro, however, said Kasperzyk nabbed the wrong man. He’d been home the whole time, babysitting his nephew, he asserted in court documents. Pizarro’s criminal charges — reckless endangerment, interfering with an officer and reckless operation of a vehicle —were nolled in New Haven Superior Court, according to the suit.
The lawsuit surrounds a claim of violation of constitutional rights when Pizarro’s door was “broken down” and a search ensued.
“You’re not allowed to break down people’s doors to chase them in a motor vehicle incident,” Polan, Pizarro’s attorney, said Tuesday. “It’s a violation of the fourth amendment.”
Her clients, Pizarro and his mother Tomasa, who was absent at the time of the raid, seek over $500,000 in economic and emotional damages for the humiliation of the arrest and the “fear, anxiety and emotional distress” of having a group of cops enter the home with guns.
Since the charges allege “willful, wanton and malicious” conduct, the city has refused to pay any monetary damages on the detective’s behalf, according to court records. (See Exhibit D). The city is paying for Attorney Stephen Del Sole of Wallingford to represent Kasperzyk. Del Sole did not return a phone message left Tuesday.
Last week, in a separate case, Kasperzyk was arrested, charged with theft of less than $1,000 as the result of an FBI sting operation. The FBI claims he swiped $360 from a pile of $5,000 that FBI agents had planted in a hotel as supposed drug money. The same $20 bills the FBI had planted then turned up at Kasperzyk’s table at an illegal poker game, the FBI claims in an affidavit, which also details charges that Kasperzyk was regularly running illegal games and chalking up as much as $40,000 to $70,000 in weekly winnings or losses. Unusual Move
The FBI sting prompted attorney Polan to make an unusual move in a civil rights case: She filed an application for pre-judgment remedy, asking the judge to put an “attachment” on Kasperzyk’s home in Killingworth before the case has been decided, freezing his home from being sold or transferred to someone else’s name.
To get a pre-judgment remedy, Polan will have to convince the judge that the Pizarros have probable cause to win their case.
Meanwhile, Kasperzyk, 34, has a filed paperwork requesting early disability retirement — a request City Hall has promised to “scrutinize” in the wake of his recent arrest. He has less than 12 years on the job.

Is there a point to this long reading list? Some of the authors you suggest are well know for not doing proper research. All institutions created by human beings ,both governmenal and private, have had some type of corruption or scandals commited by their members. Anyone could easily waste twice as much space by listing books and websites making note of the great accoplishments made by the FBI and its agents over the years.
