Maio Deal On Hold

A cop’s bid to have his record swiped clean got held up Wednesday, as two women whom he is accused of groping objected to the deal.

Maio, who has 13 1/2 years on the force, has denied wrongdoing in the case. He pleaded not guilty last year to two counts of second-degree unlawful restraint and two counts of fourth-degree sexual assault, a charge for sexual contact without consent. The officer has been on paid administrative leave for the past 11 months.
Maio appeared Wednesday in New Haven Superior Court, to seek approval from Judge Richard Damiani to enter into accelerated rehabilitation (AR), a program for first-time offenders. Under AR, defendants pay $135 and get a probation period of between one day and two years. If the defendant carries out the probation period on good behavior, then the case gets dismissed.
Damiani didn’t rule on the request for AR, which would wipe Maio’s record clean of the four misdemeanor charges. The case was postponed until May 26.
The request was held up after Maio’s alleged victims had their say.
“There are conditions that the complainants are looking for that they have expressed to the Office of the Victim Advocate,” explained Gene Calistro, Jr., senior assistant state’s attorney, who’s prosecuting the case.
Tim Pothin, Maio’s attorney, said his client’s application for AR has not been withdrawn. Discussions continue in effort to work out a deal that would satisfy all parties.
Maio will remain on paid administrative leave until a deal is worked out, said Craig Manemeit, the city’s director of labor relations. Under the police department’s Rule 16, the city is prohibited from holding any administrative disciplinary hearing until the criminal case is sorted out in court, Manemeit said. So the city couldn’t fire Maio even if it wanted to.
Manemeit said the city is in discussions with the police union and Maio’s attorney on a “resolution that’s best for all parties.”
The deal would determine whether Maio remains on the force, and whether he is allowed to remain on leave to accrue enough sick time to qualify for a full pension benefits. Right now, Maio has 13 1/2 years on the force; if he reaches 15 years, he could potentially cash in unused sick days and qualify for an age annuity pension.
Maio’s case shares characteristics with that of Det. Michael Hunter, who was arrested in September 2008 on two felony charges for allegedly misusing a national crime database. Hunter struck a deal with the city by which he agreed to retire after one year of unpaid suspension, which would boost his retirement benefits.
The criminal charges against Hunter were later dismissed.

Being a cop is tough and a lot of responsibility. The possibility of being falsely accused is a serious possibility for any cop. That is why we have a justice system, of which cops are a part. If he is innocent, he should return to work and continue to serve this community. If he's guilty and pleads out, he should not be given a bonus to help him retire. A cop breaking the law is a horrible thing. A cop breaking the law by abusing his/her power to sexually exploit a person should NEVER be given a bonus. This is the worst kind of abuse of power and should not be tolerated or condoned or be given special deals. To make matters worse, the City does not even have enough money in the retirement account for cops. We are making our minimum payments but our unfunded balance is growing out of control. Break the law, loose your job. If you don't qualify for a pension before you break the law, you should have thought about that before breaking the law. If this guy is innocent, he should get everything coming to him plus a big thank you for putting up with false accusations. Sexual exploitation by police officers should not be rewarded!!!!

I know Officer Maio from the downtown club he has patroled for years now. He has never once behaved unprofessionally. I can not believe that women would abuse the legal system in the way these women seem to be.

Here we go again...Another "Monte Hall" pension in the works. Another deal "resolution" thats best for all parties!!! Enough is enough...Follow the letter of the pension act...He qualifies for a "Vested Right" pension that he can collect at a later date. If he is let go that is all he is entitled to if he keeps his pension contributions in the fund. There is no need or reason to make arrangements to sell another pension...situations like this are "raping the pension fund". When are we going to have responsible leadership and just follow the rules and regulations? The pension board doesn't even get a chance to enforce the pension regulations because of all the deals that are made to "save" someone who has fallen by the wayside because of their own misdeeds.

Common Sense, I must concur with you. It is ashame that deals are being made behind the scenes. Why does the City have a Pension and Retirement Board? I think the officers should think long and hard about their future and the consequences when they are committing those misdeeds. But when you have someone like Hunter especially you believe you are untouchable. If I were a gambler, I'd be willing to bet he still feels he is above reproach.

Well said Johnny C Well another one on the hell list these cops should know better and you pay the piper when are they going to learn they are not above the law was not there did not see but what if it is true would this cop be up in arms if it was one of his daughters Let him go get the bad apples out and hope Chief Lewis cleans house and stays here in New Hven he is doing a great job hail to you Chief Lewis
