Appeal Stalls Nica’s Expansion

The cramped aisles and kitchen at Nica’s Market will remain that way for at least another year, as three neighbors go to court to block the latest expansion plans for the East Rock deli.

Nica’s gained permission in April from the Board of Zoning Appeals to add over 2,000 square feet to its building, a move that deli owners say would decongest” the bustling grocery at 601 Orange St. The latest plans came after two prior attempts at expansion failed amid neighborhood opposition.

Now three neighbors, including the landlord of an Italian market that competes with Nica’s, have taken the BZA to court seeking to stop what they call an illegal, arbitrary” and capricious” decision.

Mayoral spokesman Adam Joseph said the city is fighting the appeal.

The appeal was filed by Thomas Morgillo, who owns an apartment building at 595 Orange St.; Rosemarie Morgan of 124 Bishop St.; and Joseph Reagan, who owns 347 Humphrey St., which backs up to Nica’s lot. Reagan, who lives in Hamden, also owns 534 Orange St., which houses Cafe Romeo, an Italian gourmet market a few blocks away. Reagan declined comment for this story.

All three own properties within 100 feet of Nica’s and have fought Nica’s previous attempts to grow.

I oppose Nica’s expansion vehemently!” wrote Morgan in a comment in the Independent last year. Over the past few years following their last expansion” my neighboring property on Bishop St has been regularly inundated with their trash. This blows over my fence from open trash containers in Nica’s back yard.” Morgan, who raises backyard hens, went on to say that Nica’s trucks block access to cars on the street, drown out the birdsong” and pollute a residential area. Imagine what further expansion by Nica’s will do to this precious, historic area of New Haven,” she wrote.

In the latest proposal, Nica’s sought to add a new, 1,900-square-foot new building structure on the first floor to create an aisle and checkout for deli customers away from the grocery shoppers. It also sought to add 500 square feet to the second story and raise the cap on outdoor seating. In defending the plans, Nica’s attorney Marjorie Shansky argued the plans would bring not an expansion,” but operational enhancements that will be beneficial to the neighborhood.”

Nica’s has put the expansion plans on hold pending resolution of the suit against the city, according to the family that owns the market.

The lawsuit, filed by Cohen & Acampora of East Haven, claims the BZA broke the law when it granted Nica’s variances and a special exception to zoning code.

It gave Nica’s the OK to expand the first-floor grocery area from 2,446 to 4,366 square feet where 1,500 square feet are permitted; to build out to 40 percent lot coverage where 30 percent is permitted; to permit 24 outdoor seats where 15 are permitted; to add a non-conforming building to the building, which is in a residential area; and continue to run a convenience store in a residential area with 18 parking spots and outdoor seating.

An initial report prepared by Tom Talbot, deputy director of the City Plan Department, recommended that the proposal be denied. (Read that report here.)

In the lawsuit, the neighbors argue that advice should have been followed. They argue that Nica’s showed no legal hardship to justify the expansion, as required by law. And they said Nica’s had already been violating zoning law by allowing over 50 outdoor seats, when it had been permitted for only 15.

Everyone has the right to their opinion,” responded Rosanna Sabino Wednesday from behind the deli counter. Sabino runs Nica’s along with her brother and father. She said the family made neighbors part of the plan,” which drew one lone voice of opposition, compared to many in the past.

She said Nica’s is willing to wait while the court process takes its course.

The appeal definitely stalls” the planned expansion, she said, but we’re OK with it.”
