(Updated) The latest chapter of the ongoing drama with New Haven’s school superintendent has finally come to an end, as Carol Birks has signed a severance agreement to give up her position in charge of city schools for a six-figure buyout.

Birks reached a severance agreement with the Board of Education earlier this month to leave the district before her contract ends in March 2021.

The deal, which was released to reporters through the Connecticut Freedom of Information Act on Monday night, includes $175,000 in severance pay and health benefits until Birks finds another full-time job.

It prohibits either Birks or the board from suing each other. It prohibits Birks from ever applying for another job in New Haven Public Schools. It takes back all the district’s property, including laptops and cell phones. And it keeps her evaluation, which Board of Education President Darnell Goldson said was never put on paper, incomplete, meaning it will never be released to the public.

The deal prohibits anyone from explaining why Birks is leaving this way.

If anyone asks Birks, she has to say something to the effect of We settled,” The matter was resolved,” or We resolved our differences.” If anyone asks the board members, they are prohibited from disparaging or defaming her. If anyone asks the school district’s human resources office, they will provide her title, her dates of employment and her salary.

The agreement includes a public statement about why Birks is leaving. It reads:

The New Haven Board of Education and Dr. Carol D. Birks have mutually agreed that Dr. Birks’ employment as Superintendent of New Haven Public Schools will end on October 31, 2019.

The Board of Education thanks Dr. Birks for her service to the families and staff of the New Haven Public School system.

The Board of Education and Dr. Birks are committed to ensuring that the outstanding work of the staff and students of New Haven Public Schools will continue on a path of continuous improvement. As a result of this commitment and their mutual desire to create a smooth plan for the transition of leadership, Dr. Birks will remain available to the board for any queries related to NHPS operations at no additional cost until December 31, 2019.

On Monday night, Ilene Tracey was approved as interim superintendent. She’ll officially take over the role on Friday. Goldson said that he is still negotiating her contract, after the board gave him permission at a meeting at King-Robinson School.

The deal has nearly concluded more than a year of seemingly daily drama — right up to the deadline. Weeks went by, as Birks held off from signing the agreement.

The deal was set to expire last Friday. Birks signed in mid-afternoon, then Goldson rushed to find a notary to make it legally binding.

But there’s still one last catch. Birks has a full week in which she can decide to rescind her signature, before it officially takes effect.
